BIDDER INFORMATION AND TERMS AND CONDITIONS OF SALE
SONOMA PARADISO, its supporting entities, co-chairs, and auctioneers (Event Management) are not responsible for the accuracy of the text describing the auction lots shown in this catalog. The descriptions may incorporate materials or descriptions furnished by donors. Prospective bidders should make their own judgments with reference to the quality, value and suitability of each or any particular auction item for their purposes, schedules and tastes. All items, including wine, are sold “as-is.” Event Management makes no warranties, assumption of liability or representation of any kind or nature, express or implied, with respect to any property included in an auction lot.
Event Management may adjust or change lot order, auction protocol and the like as they deem appropriate with announcement thereof as late as the moment of change. The auctioneers shall have the absolute right to withdraw any auction lot and reject any auction bid. In the event of any dispute between bidders, the auctioneers shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the item in dispute. No bid is valid unless acknowledged as such by one of the auctioneers, and the highest bidder acknowledged by the auctioneers shall be the purchaser. A bid acknowledged by the auctioneers is a legal contract to purchase the item for the bid amount. If any dispute arises after the sale, the event records shall be conclusive in all respects. Values for items being auctioned are donor/Event Management’s best estimates, and are not warranted for general value.
Any trips or events comprising all or part of an auction lot shall, unless otherwise specified in the catalog description, be subject to availability and the winning bidder must schedule such trips or events on mutually agreeable dates to the winning bidder and the lot donor(s). In addition, unless otherwise specified, winning bidders of trips or events must schedule the trip or event to occur within twelve (12) months of the auction. Donor may vary or substitute specific auction lot details if the donor is unable to provide such items due to circumstances beyond the donor’s control. The winning bidder is responsible for making reservations with the donor, unless otherwise noted.
BIDDERS CONSIDERING BIDDING ON THE FOLLOWING LOTS SHOULD CAREFULLY CONSIDER THE FOLLOWING INFORMATION AND CONDITIONS:
Telsa: Zero Emissions Lot 10: The 2008 Tesla Roadster will be offered at the auction for bids in excess of $125,000 (the "Vehicle Reserve Price"). The person submitting the highest bid in excess of the Vehicle Reserve Price will be awarded the right to acquire the vehicle. The winning bidder must reside in the 48 contiguous states. Payment for the vehicle will be the responsibility of the winning bidder. The winning bidder will receive title to the vehicle upon payment to Tesla Motors of the Vehicle Reserve Price plus all applicable dealer vehicle delivery fees, sales tax, license and registration fees in the state of its delivery and registration. Delivery will occur 3 to 4 months after payment for the Vehicle has been received and all customizations options have been ordered by the winning bidder. All customization options will be arranged with Tesla Motors’ Operations Manager, Colette Niazmand, 1050 Bing Street, San Carlos, CA 94070, (650) 413-4009. The winning bidder will be required to pay the amount by which the bid exceeds the Vehicle Reserve Price directly to Sonoma Paradiso at the event on Saturday, September 27, 2008.
The World at Your Fingertips Lot 17: Cruise for two couples aboard the World must be completed by December 20, 2009, on mutually agreed upon dates. Reservations are subject to availability and to the following blackout dates: July 13 - August 26, 2009. Cruise must be taken consecutively over a 7-night period. Package includes ship passage, one-hour complimentary spa treatments and all on-board accommodations, meals, beverages, gratuities and port charges for four; excludes any optional shore excursions and on-board personal expenses. Air travel, pre- and/or post-cruise hotel accommodations, and transfers to and from ship are not included and are responsibility of winning bidder and guests. Offer non-transferable and not redeemable for cash.
Michael Beaudry Timepiece Lot 29: The Ladies Duet, Limited Edition, from The Beaudry Timepiece Collection (#2 of 24 pieces) will be offered at the auction for bids in excess of $68,750 (the "Reserve Price"). The person submitting the highest bid in excess of the Reserve Price will be awarded the right to purchase the Beaudry Timepiece. The winning bidder will receive the Beaudry Timepiece at the event after payment of the Reserve Price directly to Michael Beaudry. The winning bidder will be required to pay the amount by which the winning bid exceeds the Reserve Price directly to Sonoma Paradiso at the event on Saturday, September 27, 2008.
Bentley Continental Flying Spur Speed Edition and Trip to Crewe, England Lot 36: A 2009 Bentley Continental Flying Spur Speed Edition vehicle and a trip for two persons to Bentley’s Crewe, England factory (consisting of two business class tickets from a major U.S. hub of American Airlines to Manchester, England; a three-night stay at Rookery Hall, Nantwich, Cheshire, England; airport transfers to and from the airport in Manchester, England; and a tour of the factory) will be offered at the auction for bids in excess of $210,000 (the "Reserve Price"). The person submitting the highest bid in excess of the Reserve Price will be awarded the right to purchase the vehicle and to receive the trip. The winning bidder will be required to reside in the U.S. The winning bidder will be required to designate an authorized U.S. Bentley retailer for purposes of receiving delivery of the vehicle, will be required to pay the designated retailer for the vehicle, and will be required to register the vehicle in the U.S. The winning bidder will have the option of ordering the vehicle or taking delivery from retailer stock. If the winner bidder chooses to order the vehicle, the winning bidder will be required to submit the order for the vehicle on or before February 28, 2009. The winning bidder will have the right to order customized options for the vehicle, but will be required to pay for the costs of the customized options. The winning bidder will receive delivery of the vehicle on or before July 31, 2009. The winning bidder will receive title to the vehicle upon payment to the designated retailer of the Reserve Price, plus the price of all customized options, plus all applicable retailer vehicle delivery fees, sales taxes, and license and registration fees. The winning bidder will be required to take the trip on mutually agreed-upon dates, and will be required to complete the trip on or before December 31, 2009. The winning bidder will be responsible for the costs of additional time spent on the trip, including the costs of extra flights and accommodations. The winning bidder and all persons taking the trip will be required to sign a release of liability. The winning bidder will not be permitted to transfer the lot and may not redeem the lot for cash. The winning bidder will be required to pay the amount by which the winning bid exceeds the Reserve Price directly to Sonoma Paradiso at the event on Saturday, September 27, 2008.
ALL SALES FINAL.
All sales are final. There will be no refunds or exchanges unless specifically noted in the auction item description. Group purchases are welcome; however one person must be responsible for the bidding and payment. All sales are subject to the provisions of California law.
PAYMENTS
PAYMENT MAY BY MADE with cash, credit card (we accept American Express, Visa and MasterCard) and checks (upon approval of Event Management). Approved checks must be payable to Sonoma Paradiso.
To make your auction shopping as convenient as possible, Sonoma Paradiso is pleased to offer an express checkout option for all guests who wish to pay by credit card. Simply present your credit card at registration, and your credit card information will be encrypted and stored in our secure system. All auction items for which you made the winning bid will be charged to your account upon completion and confirmation of all winning bids. You will receive an invoice for each item purchased at the conclusion of the event. Payment in full must be made at the Sonoma Paradiso event on Saturday, September 27, 2008.
AUCTION LOT PICKUP AND SHIPPING
TO PICK UP AUCTION ITEMS: Upon payment for your auction items, you will be given an invoice. You must present this invoice to claim your purchases. Some smaller items may be picked up at the registration area. Event Management will not be responsible for any items left at the auction site after delivery to the bidder.
TO HAVE AUCTION ITEMS SHIPPED OR DELIVERED: In the event that shipping of an auction item is necessary, Event Management will assist winning bidder in arranging for delivery, to the extent permitted by applicable law, and with appropriate charges added in, including shipping, handling and insurance (if requested by the winning bidder). Shipping regulations vary from state to state, particularly with respect to wine, and out-of-state bidders shall be responsible for compliance with the laws of the destination state or locality and for providing the proper information to allow Event Management to make shipping arrangements. Shipping arranged by Event Management is guaranteed only to the extent and rules of the shippers. No other warranties are made, and lost items must be tracked through the shipper by the bidder.
TAX APPLICABILITY
PURCHASERS shall be required to pay all state and local retail sales or use taxes as may be applicable.
FEDERAL TAX INFORMATION
FOR FEDERAL INCOME TAX PURPOSES, all payments for auction lots shall be made to Sonoma Paradiso. Sonoma Paradiso is administered for the beneficiary charities by Community Foundation Sonoma County, which is classified as a tax exempt corporation under Internal Revenue Code Section 501(c)(3). Bidders may be entitled to deduct a portion of their payments for auction lots as a charitable contribution. Bidders should consult their tax advisor regarding deductibility for state or federal income tax purposes.
The estimated fair market value of each seat purchased at the Sonoma Paradiso auction is $175 per seat purchased for Friday, September 26, and $175 per seat purchased for Saturday, September 27. Event sponsors and ticket purchasers should consult their tax advisor regarding deductibility for state and federal income tax purposes.
